TechGen Host Terms And  Conditions

We’ve updated point no. 08 (Refunds and Anti-Fraud Policy), effective from May 17, 2024, to clarify that purchases of certain add-on products such as SiteLock are non-refundable. And on May 19, 2024, we included point no. 17 (Resource Usage) to clarify our policy on resource usage of WordPress plugins and themes, which is included in our new terms applicable to the users of WordPress plugins and themes .

These Terms of Service (the “Agreement”) are an agreement between TechGenHost.com (“TechGenHost”, “us”, “our”, or the “Company”) and you (“User” or “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the products and services made available by TechGenHost and of the TechGenHost.com website (collectively, the “Services”). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this agreement, you are not authorised to use or access our services.

All users of TechGenHost services, and all customers, upon signing up for TechGen Host services, (is/are) agree to comply with and be bound by these Terms and Conditions (TAC). The spirit of the TAC is to ensure customers are using Techgen Host services with due regard to the rights of other Internet users and in conformity with the requirements of the TechGen Host network. The TAC are not exhaustive, and TechGen Host reserves the right to add, delete, or modify any provision of its TAC at any time without notice, effective upon either the posting of the modified TAC to www.techgenhost.com or notification of the modified TAC.
Any complaints about a customer’s violation of the TAC should be sent to support@techgenhost.com. The TAC supersedes any other agreement with TechGen Host, whether written, oral, by conduct, or otherwise.

Payment or purchase towards any domain specifically by any client or clients will be considered only as a product booking, as techgenhost.com has the right to cancel any domain/domains at any time, even after client payment as well, if the booking of such domains does not comply with our terms and conditions.

The booking amount towards the domain may be held by the company for up to 48 to 72 hours as the booked domain undergoes a propagation, policy compliance, and scrutiny process.

TechGen Host may cancel any booked domain of any client at any time due to non compliance of our policy without prior notice to our client, even after their booking as well.
In case of cancellation, refunds will be initiated only after getting the written refund request from the client, which will be complied with in 3 to 5 working days. This term is applicable for the purchase of a domain only, not for hosting. As the refund policy of Hosting is mentioned in the refund and cancellation area.

Booking of any domain from the client will never be considered the ownership of the client, even after payment, until the domain gets reviewed and completely activated by TechGen Host, which may take a due course of time as specified earlier. 

All booked domains will be pending until it gets activated by TechGen Host, though it may show as an active domain in the client/customer dashboard as it needs propagation to process the same.

All booked domains may get activated within 36 to 72 hours (needed time for global propagation) after the successful payment of clients/customers.

Even after booking of any domain, if the domain found in the Premium category, then Techgen Host will cancel the domain at any time without any prior notice to the concerned client or customer.

Even after booking any domain, if it is found to be sold/unavailable/any other issue, Techgen Host has the right to cancel the domain without any prior notice to the client or customer, as TechGen Host does not hold any power/right of domain aggregatorship.

Even after booking of any domain/domains, if TechGen Host finds that the booked domain/domains belong to any brand/corporate/reputed company through which legal issue may arise in the future, then the booked domain/domains will be cancelled by Techgen Host at any time without any prior notice to the client/customers, and refund will be initiated by 3 to 5 working days after getting a written refund request from the client.
There should not be any legal liabilities of Techhgen host.com whether any of such domains get booked by using our platform. All legal responsibilities and liabilities will belong to the concerned client/clients in case of booking of such domain/domains. No client/clients can make techgenhost.com as a party in any of such legal cases if it arise in the future.

Purchase of domain /domains will be the sole responsibility of the client/user/customer.

TechGen Host reserves the right to modify these Terms and Conditions at any time. We will notify you of any changes by posting the new terms on this page. And your continued use of the services after the posting of the revised terms constitutes your acceptance of the modifications.

Techgen Host provides domain registration and web hosting services. While we strive to offer high-quality service, we do not guarantee that our services will be uninterrupted or error-free.

To use Techgen Host services, you must register for an account. You agree to provide accurate, correct, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

Techgen Host offers various payment options for ease of payment to the customer mentioned on our website, which may change at our sole discretion. Transaction fees and service charges of payment options are separate and must be added to your total account fee separately and paid in total. All payments are non-refundable except as expressly provided in these Terms. We accept payments through UPI, Debit and Credit cards, and Net Banking.

Users are solely responsible for the content that is uploaded to their website and for ensuring that it complies with applicable laws and regulations. As you agree not to use our services for any unlawful purpose.

Techgen Host may terminate or suspend your account at our sole discretion, without prior notice or liability, for conduct that we believe violates these Terms or is harmful to other users of our services, us, or third parties, or for any other reason.

Under no circumstances shall Techgen Host, its affiliates, directors, employees, or agents be liable for any direct, special, indirect, or consequential damages, or any other damages of any kind, including, but not limited to, loss of use, loss of profits, or loss of data, whether in an action in contract, tort (including but not limited to negligence), or otherwise, arising out of or in any way connected with the use of our services.

Techgen Host can not be held responsible for any loss of data or any other issue related to the client website due to such incident towards any cyber attack, malware injection, or any of such illegal activities if it occurs on the client’s website. As the clients are solely responsible for the maintenance and to provide security of their own websites, which is needed additionally. 

You agree to defend, indemnify, and hold harmless Techgenhost, its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the services or your violation of these Terms.

These Terms are governed by and construed in accordance with the laws of India, without regard to its principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts located in [Insert Location, e.g., Kolkata], and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

1. FREENOM Domains Not Allowed

We don’t allow freenom domains on any hosting. If you place an order with a freenom domain and use it for spamming purposes, your account will be suspended immediately and no refunds will be issued.

2. Spamming

Sending unsolicited bulk and/or commercial messages over the Internet (known as “spamming”) is prohibited, regardless of whether it overloads a server or disrupts service to TechGenHost.com’s customers. TechGenHost reserves the right to determine, in its sole discretion, what constitutes a violation of this provision.

3. Illegal Use

TechGenHost services may be used only for lawful purposes. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation or that facilitates the violation of any law or regulation is prohibited. This includes, but is not limited to, copyrighted material, trademarks, trade secrets, or other intellectual property rights used without proper authorization, as well as obscene, defamatory, or illegal content that violates export control laws..

4. System and Network Abuse

The use of TechGenHost.com’s services to store, post, display, transmit, advertise, or otherwise make available any type of pornography is prohibited. TechGenHost.com will notify law enforcement agencies when it becomes aware of the presence of pornography on or being transmitted through its services.

5. Pornography

Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include unauthorized access to data, systems, or networks, interference with service to any user or network, mail bombing, deliberate attempts to overload a system, and broadcast attacks.

The use of techgenhost.com’s services to store, post, display, transmit, advertise, or otherwise make available any type of pornography is strictly prohibited. Techgenhost.com, as required by law, will notify law enforcement agencies when it becomes aware of the presence of pornography on, or being transmitted through its services.

6. Backup Policy

Your use of the Services is at your sole risk. You agree to back up all of your User Content so that you can access and use it when needed.

If you purchase shared hosting, WordPress hosting, or cloud hosting services, TechGenHost will provide backups for a duration of 7 days. If you do not renew your services and need a backup after the renewal period, you must renew your services first. Once renewed, you will be able to create and download the backup yourself.

TechGenHost does not guarantee the availability of backups for accounts with lapsed or expired services. If a user requests a backup without renewing their service first, it will not be possible. After the renewal, the user can create and download their backup. Additionally, if services are renewed after the due date, a late fee will be charged to retain the backup during the lapsed period.

Furthermore, if your account uses more than 3GB of storage, we recommend you maintain a manual backup of your data. In some cases, our system may not be able to create backups for files larger than 3 GB. It is your responsibility to ensure that you have a backup in such situations.

7. Software/WebPanel/API Change

We don’t allow freenom domains on any hosting. If you place an order with a freenom domain and use it for spamming purposes, your account will be suspended immediately and no refunds will be issued.

8. Refund and Anti-Fraud Policy

If a user provides fake details such as their full name, address, phone number, email address, or any other information when creating an account and purchases any services, they will not be eligible for a refund, nor will a refund be provided. Even if you correct these fake details later, it will be considered that you intended to misuse the services. As a result, your services may be suspended without notice. TechGenHost complies with government regulations and does not promote any illegal activities. If you engage in such behavior, you will be solely responsible, not TechGenHost. Users who provide accurate information will not face any issues.

Whether it’s yearly or monthly plans, users who provide accurate details will be eligible for a refund within 24 to 48 hours of purchase. Refunds are not available for domain registrations, regardless of the duration (1 year, 2 years, or more). Shared hosting, offshore hosting, WordPress hosting, and cloud hosting are eligible for a refund within 24 to 48 hours. No refunds are available for domains or any additional products like CodeGuard, SiteLock, or SSL certificates.

9. Viruses and Other Destructive Activities

Use of TechGenHost.com’s services or equipment for creating or sending Internet viruses, worms, or Trojan horses, or for pinging, flooding, or mail bombing, or engaging in denial-of-service attacks is prohibited.

10. Account & Activities

TechGenHost does not promote accounts created with fake details. If your account is found with fake information, it may be deleted without refunding any services. Make sure to add a valid company name, email, and phone number, and verify your email to avoid inconvenience.

11. Offshore Hosting

We offer offshore hosting services to provide an additional layer of privacy and security. By choosing offshore hosting, you understand and agree that data protection laws may vary, and it is your responsibility to comply with the laws of the jurisdiction where your hosted data resides. TechGenHost is not liable for any legal implications arising from the use of offshore hosting services.

12. Downgrading Yearly Hosting Plans

Downgrading from a yearly hosting plan to a monthly plan at the time of expiration is not possible. If your yearly plan expires and you wish to continue using our services, you will be required to renew for a minimum term of 3 months.

13. User Liability for Misuse

Users are solely responsible for the content hosted on our platform. Any misuse, illegal activities, or violation of these terms and conditions will result in the user being held accountable. TechGenHost disclaims all liability for damages or legal consequences arising from the user’s misuse of our services.

14. Client Behavior and Misuse

If any client engages in misbehavior, spamming, or inappropriate activities with our 24/7 support team, TechGenHost reserves the right to immediately suspend their domains, hosting services, websites, or any other work. Their account may also be permanently closed. TechGenHost does not tolerate spamming, and such actions will result in service termination without refund. The client will be solely responsible for such actions, and TechGenHost will not be liable for any consequences.

15. Phishing Pages Prohibited

TechGenHost strictly prohibits hosting phishing pages, such as clones of shopping sites, credit card sites, or other popular websites. If you host such content, TechGenHost reserves the right to immediately terminate your services without any refund. Additionally, TechGenHost will not be responsible for any legal consequences arising from such actions. You are fully responsible for any misuse of your account.

16. Fair Usage of Resources

TechGenHost offers unlimited bandwidth and disk space on certain hosting plans. However, users are expected to use these resources fairly. If your account causes excessive server load or resource consumption that affects other users, we may suspend or limit your account’s usage. Failure to comply with these fair usage guidelines may result in suspension or termination of your services.

17. Refund Eligibility for Website Development Services or any third party plugins or themes (Resource Usage) 

TechGen Host cannot be held responsible for any third-party modules, (plugins, and themes), and we cannot be held responsible for their functionality, compatibility, or performance issues related to those third-party  components (plugins, and themes). If a third-party component fails to work as expected, we may help you to identify and resolve the issue with our sole discretion. However, no refund will be issued for such issues inherent to third-party components that are beyond our control.

TechGen Host Affiliate Marketing Program Terms and Conditions

1. Eligibility and Enrollment
To participate in the TechGenHost affiliate program, you must be at least 18 years old and capable of entering into legally binding agreements.
You must complete and submit the online application form. All applications are subject to approval by TechGenHost.
TechGenHost reserves the right to reject any application at its discretion.

2. Commission Structure
Affiliates will earn a commission of [Twenty percentage] 25% on each sale generated through their referral link.
Commissions are subject to a minimum payout threshold of Rs.500/-.
Commission rates and payout thresholds may be adjusted at TechGenHost’s discretion.

3. Payment Terms
Commissions will be paid on a monthly basis via [GPAY/ PHONE PE / UPI payment method.
Payments will be made within 05 days after the end of the month in which the commission was earned.
Affiliates are responsible for ensuring that their payment details are accurate and up-to-date.

4. Affiliate Responsibilities
Affiliates are responsible for ensuring that their affiliate links are properly formatted.
Affiliates must not engage in deceptive or fraudulent practices to generate sales.
Affiliates must comply with all applicable laws and regulations in their promotional activities.

5. Marketing and Promotional Materials
Affiliates are permitted to use the promotional materials provided by TechGenHost only.
Affiliates are not entitled to alter or modify the promotional materials without prior written consent from TechGenHost.
Affiliates must not make any false or misleading statements about TechGenHost’s services.

6. Prohibited Activities
Affiliates must not engage in spamming, unsolicited emailing, or other forms of invasive marketing.
Affiliates are prohibited from bidding on TechGenHost’s trademarks or using them in any domain names.
Affiliates must not use their own affiliate links for personal purchases.

7. Termination
TechGenHost reserves the sole right to terminate an affiliate’s account at any time for any reason.
Affiliates may terminate their participation in the program at any time by providing written notice to TechGenHost.
Upon termination, all rights to unpaid commissions will be forfeited.

8. Confidentiality
Affiliates must maintain the confidentiality of any non-public information they receive from TechGenHost.
Affiliates are prohibited from disclosing this information to any third parties without prior written consent from TechGenHost.

9. Limitation of Liability
TechGenHost is not liable for any indirect, incidental, or consequential damages arising from the affiliate program.
TechGenHost’s total liability to an affiliate will not exceed the total commissions paid to the affiliate.
Affiliates agree to indemnify and hold harmless TechGenHost, their directors, and employees from any claims, damages, or expenses resulting from their participation in the program.

10. Modification of Terms
TechGenHost reserves the right to modify these terms and conditions at any time without any prior notice.
Affiliates will be notified of any changes, and continued participation in the program constitutes acceptance of the modified terms.

11. Reporting and Tracking
TechGenHost will provide affiliates with access to a reporting system to track sales and commissions.
Affiliates are responsible for regularly reviewing their reports and notifying TechGenHost of any discrepancies.

12. Account Maintenance
Affiliates must keep their account information up-to-date, including contact and payment details.
TechGenHost is not responsible for any delays or failures in commission payments due to incorrect account information.

13. Compliance with Laws
Affiliates must comply with all applicable laws, including data protection and privacy regulations.
Affiliates must not engage in any activity that may damage the reputation of TechGenHost.

14. Relationship of Parties
Affiliates are independent contractors and are not employees, agents, or partners of TechGenHost.
Affiliates have no authority to bind TechGenHost or incur obligations on behalf of TechGenHost.

15. Governing Law
These terms and conditions are governed by the laws of India.
Any disputes arising from the affiliate program will be resolved in the courts of [Jurisdiction].
By participating in the TechGenHost affiliate program, you agree to abide by these terms and conditions. If you do not agree to these terms, you must discontinue your participation in the program.
